1. GENERAL TERMS & CONDITIONS

This website is owned and operated by nAr Design + Build LLC ("nAr," "Company," "we," "us," or "our"), a Connecticut-based residential Design + Build firm providing architectural design, interior architectural design, construction documentation, construction management, and residential construction services.

By accessing or using this website, visitors acknowledge these Terms & Conditions. Use of this website is subject to these Terms to the extent permitted by applicable law and the visitor's legally effective acceptance of them.

All website materials are presented for informational, promotional, and professional portfolio purposes. Accessing this website does not establish a professional, contractual, or fiduciary relationship with nAr Design + Build LLC.

2. INTELLECTUAL PROPERTY & COPYRIGHT

All original architectural designs, interior architectural drawings, floor plans, elevations, cabinetry layouts, millwork details, construction drawings, technical specifications, CAD files, Revit models, three-dimensional renderings, illustrations, and other original materials created by or legally assigned to nAr Design + Build LLC remain the intellectual property of the Company.

Such materials are protected under applicable United States copyright laws to the extent they qualify for copyright protection.

Unless expressly authorized in writing by the applicable rights holder or permitted by law, no person or entity may reproduce, distribute, modify, commercially exploit, or incorporate protected website materials into another design or construction project.

Publication of materials on this website does not transfer ownership of intellectual property or grant third parties permission to reproduce protected content.

nAr reserves all rights, remedies, and protections available under applicable intellectual property laws.

Projects presented on this website may involve collaboration with independent architects, interior designers, consultants, engineers, suppliers, subcontractors, manufacturers, and other professionals.

Each professional retains any intellectual property rights lawfully held in their own original work, subject to applicable agreements, assignments, licenses, and governing law.

The selection, sourcing, recommendation, purchasing, or specification of commercially available products, materials, fixtures, cabinetry, furnishings, finishes, and decorative elements does not, by itself, establish copyright ownership of architectural designs, interior elevations, construction documents, or other independently authored design materials incorporating those selections.

Likewise, participation in preliminary design discussions, conceptual presentations, or project coordination does not automatically confer exclusive ownership of the final architectural or interior design.

nAr retains its lawful intellectual property rights in the original designs, drawings, and documentation independently developed by the Company.

Professional participation, consultation, or product sourcing by third parties shall not be construed as transferring ownership of nAr's independently authored materials absent a legally effective agreement or other applicable basis.

Design authorship, professional credit, and intellectual property ownership are distinct matters and shall be evaluated according to actual contributions, governing agreements, and applicable law.

All project photographs, videos, renderings, and visual materials appearing on this website are displayed pursuant to ownership rights, licenses, permissions, or other lawful authority held by nAr Design + Build LLC.

Photographic copyright remains with the applicable copyright owner unless legally transferred to another party.

Where nAr has commissioned photography or otherwise obtained appropriate usage rights, the Company may use such photography within the scope of those rights for advertising, company portfolios, social media, professional publications, project presentations, and industry recognition.

The presence of fixtures, finishes, furnishings, decorative elements, or products selected or supplied by third parties within project photographs does not, by itself, provide those third parties with copyright ownership of the photographs or the authority to prohibit their lawful publication.

No person may reproduce, distribute, sell, license, or commercially exploit protected project photography without authorization from the applicable rights holder, except as permitted by law.

Project imagery may include professionally edited photographs, architectural renderings, conceptual presentations, or other visual representations. Such materials are not necessarily representations of existing as-built conditions.

Subject to applicable intellectual property rights, privacy obligations, signed agreements, and other legal restrictions, nAr Design + Build LLC may document and publicly represent projects in which the Company has performed design, construction, construction management, or related professional services.

Such representations may include:

• Company website portfolios and social media publications.

• Professional photography, videos, and advertisements.

• Editorial features and architectural publications.

• Marketing materials and company presentations.

• Residential design, remodeling, construction, and Design + Build award submissions.

• Other lawful promotional or professional uses.

nAr may accurately identify and describe its own design, documentation, construction, craftsmanship, project management, and related contributions.

The participation of an outside consultant, designer, supplier, or other professional does not, by itself, establish exclusive ownership of the completed project or create a general right to prohibit nAr's lawful publication of its independently performed work.

All portfolio presentations, award submissions, and professional representations remain subject to applicable competition rules, third-party intellectual property rights, privacy requirements, and project-specific agreements.

Nothing herein authorizes nAr to misrepresent the authorship of another party's original work.

nAr Design + Build LLC respects the intellectual property rights of other parties and takes good-faith copyright concerns seriously.

Any individual or entity asserting ownership of specific copyrighted material appearing on this website may submit a written notice identifying the copyrighted work, the alleged copyright owner, the material appearing on this website, and the basis for the asserted infringement.

Supporting documentation may include original creative files, dated drawings, applicable copyright registrations, written assignments, relevant contracts, or other records establishing authorship or ownership.

The existence of a consulting agreement, professional designation, project involvement, finish specification, material purchase, or other participation does not independently establish copyright ownership of work created by another professional.

nAr reserves the right to evaluate copyright allegations, request relevant documentation, dispute unsupported claims, and pursue available legal remedies.

No statement within these Terms is intended to waive or limit any party's rights under applicable federal copyright law, including lawful reporting, enforcement, or judicial remedies.

These website Terms & Conditions are separate from and do not supersede written agreements executed between nAr Design + Build LLC and its clients, consultants, photographers, engineers, subcontractors, or other professional parties.

Where an enforceable written agreement expressly governs copyright ownership, design documents, photographic usage, professional attribution, confidentiality, or project publication, the applicable agreement shall control the rights and obligations of its parties.

Nothing contained in these Terms shall transfer ownership of third-party intellectual property to nAr or diminish rights established under applicable law.

These Terms & Conditions shall be governed by the applicable laws of the State of Connecticut and the United States, without regard to conflict-of-law principles.

To the extent permitted by applicable law and subject to the existence of an enforceable agreement, disputes arising under these website Terms shall be brought before a court of competent jurisdiction in Connecticut, with venue in Fairfield County where legally appropriate.

Nothing in this section limits non-waivable statutory rights or alters the governing law or dispute-resolution provisions of separately executed agreements.

The Company has designated January 1, 2024, as the reference effective date for these Terms & Conditions.

This version was revised October 20, 2026. The stated effective date does not represent a warranty that this version was published or accepted on January 1, 2024.

New or revised provisions apply only from the time they are lawfully published, communicated, and accepted where acceptance is required. They do not retroactively alter previously established contractual rights, copyright ownership, or completed transactions.

nAr reserves the right to revise these Terms as necessary. Updated provisions shall apply prospectively, subject to appropriate notice and any consent required by law.

If any provision is held unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
